License. We grant you a personal, non-exclusive, non-transferable license to use the software we make available to you, in object code form, for your own use in accordance with these terms and any separate license file included with the software (for example, an open-source license for community builds).
Acceptable use. You may not misuse kuku, attempt to break or circumvent security, reverse engineer the software except where law permits, use it to violate others’ rights, or resell or redistribute it without permission.
Accounts and services. If we offer sign-in, sync, or other online services, additional rules may apply. You are responsible for your account credentials and for activity under your account.
Updates. We may ship updates, including automatic updates where enabled. Some features may change or be discontinued over time.
Disclaimer. kuku is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the software will be uninterrupted or error-free.
Limitation of liability. To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of kuku. Our total liability for any claim relating to the software is limited to the greater of fifty U.S. dollars or the amount you paid us for the software in the twelve months before the claim.
Indemnity. You agree to defend and indemnify us against claims arising from your misuse of kuku or violation of these terms, to the extent permitted by law.
Termination. We may suspend or terminate access to services or updates if you materially breach these terms. You may stop using kuku at any time.
Governing law. These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules, except where prohibited. Courts in New York have exclusive jurisdiction for disputes, unless law requires otherwise.
Changes. We may revise these terms by posting a new version on this page. Continued use after changes become effective constitutes acceptance of the revised terms.
